About the Waste Tire Enforcement (WTE) Program

The California Department of Resources Recycling and Recovery (CalRecycle) is responsible for tire pile stabilization and remediation in cases where public health and safety and the environment is at risk. The Legislature recognized the need for waste tire management and passed the California Tire Recycling Act. For more information, read the Overview of Tire Management in California.

The Orange County Health Care Agency (OCHCA) is the Tire Enforcement Agency (TEA) responsible for performing initial and follow-up inspections for all waste tire generators, haulers, and end-use facilities in Orange County. The central objective is to determine, document, and achieve compliance with California’s waste tire laws and regulation through ongoing oversight and operator education.

It is very important for you to understand that under the waste tire manifest system, your primary business activity is not the only factor to be considered (for example, being a waste tire generator or hauler), but rather what role(s) you play with respect to each specific movement of waste and/or used tires. This determines your responsibilities and the forms you are required to complete. Use the following table to assist in determining your role:

  • Statute requires annual used/waste tire hauler registration which is valid through the calendar year (December 31). Persons intending to become waste tire haulers must register prior to hauling used or waste tires. Waste tire generators typically include (but are not limited to) the following types of operations where waste or used tires are submitted
for transportation, for offsite handling, altering, storage, disposal, or for any combination thereof:

  • New and used tire dealers
  • New and used car dealers
  • Automobile and truck fleet operators
    • rental car companies
    • school districts
    • government motor pools
  • Auto dismantlers
  • Agricultural user 

Under the waste tire manifest system, waste tire generators are responsible for the following:

State law requires every person who transports 10 or more used/waste tires within California to be a registered tire hauler and to transport waste/used tires only to authorized facilities. Registered haulers shall initiate a comprehensive trip log or electronic manifest for waste/used tire loads, possess the comprehensive trip log or electronic manifest during transportation, and retain comprehensive trip log or electronic manifest for 3 years

End-use facilities are those locations where waste or used tires are accepted for handling, altering, storage, disposal, or any combination thereof. End-use facilities that accept waste tires must be an authorized or permitted waste tire facility under regulations administered by CalRecycle.
